1. Introduction

PAIA gives effect to the constitutional right of access to any information held by the State and any information held by another person that is required for the exercise or protection of any rights. This manual is published in terms of section 51 of PAIA to assist any person who wishes to request access to a record held by Logix Design and Development (“LDD”, “we”, “us”, “our”). It also explains how a data subject may exercise their rights under POPIA in relation to personal information we process.

4. The Guide on how to use PAIA (section 10)

The Information Regulator has, in terms of section 10 of PAIA, published a Guide on how to use PAIA, which contains information reasonably required by a person who wishes to exercise any right under PAIA or POPIA. The Guide is available in each official language from the Information Regulator, using the contact details in paragraph 5 below, or on the Regulator’s website at inforegulator.org.za.

6. Records available in terms of other legislation (section 51(1)(d))

Certain records held by LDD are available in terms of, and subject to, other legislation. These include (this list is not exhaustive):

7. Categories of records held by LDD (section 51(1)(e))

Records are held in the following subject categories. The listing of a category does not mean access will be granted — every request is assessed against the grounds for refusal in PAIA.

  • Company & statutory records – registration documents, Memorandum of Incorporation, statutory registers, minutes, resolutions.
  • Financial records – accounting records, invoices, quotations, bank records, tax and VAT records, financial statements.
  • Employee & human-resources records – contracts of employment, payroll, leave, disciplinary, training and personnel files.
  • Client & customer records – service agreements, quotations, orders, project documentation, support tickets and correspondence.
  • Supplier & vendor records – contracts, purchase orders, invoices and correspondence.
  • Operational & technical records – project and system documentation, configurations, monitoring and security data generated by our managed services (InfraPulse, ThreatPulse, VaultPulse, SearchPulse) on behalf of clients.
  • Marketing & website records – marketing material, enquiries and website analytics.
  • Information & cyber-security records – policies, logs and incident records.

8. Records available without a formal PAIA request

Some information is available without a PAIA request, including material published on www.ldd.co.za (service and product information, this manual and our Privacy Policy) and information provided to clients under their service agreements. This does not form part of the section 52 voluntary-disclosure notice.

9. Processing of personal information (POPIA)

Categories of data subjects: clients and prospective clients, employees and job applicants, suppliers and service providers, and website users.

Categories of personal information: names and contact details, identity/registration numbers, financial and billing information, employment information, and technical/usage data.

Purpose of processing: to provide and manage our IT and security services, administer contracts, comply with legal obligations, and manage our business and website.

Recipients: employees on a need-to-know basis, and operators/third-party service providers under written agreement (e.g. hosting, email and payment providers).

Cross-border transfers: where personal information is transferred outside South Africa, it is done in accordance with Chapter 9 of POPIA.

Security safeguards: we maintain reasonable technical and organisational measures to protect personal information as required by section 19 of POPIA.

Data-subject rights: subject to POPIA, a data subject may request access to, or correction or deletion of, their personal information, and may object to processing, by contacting the Information Officer at infosec@ldd.co.za. Full detail is set out in our Privacy Policy.

10. How to request access to a record

  1. Complete the prescribed request form — the “Request for Access to Record of Private Body” form (Form 2) prescribed under the PAIA Regulations, 2021, obtainable from the Information Regulator’s website at inforegulator.org.za.
  2. Submit the completed form to the Information Officer at infosec@ldd.co.za (or the postal address above).
  3. Provide sufficient particulars to identify the record and the requester, the form of access required, and — where the request is to exercise or protect a right — identify that right and explain why the record is required.
  4. Pay the prescribed request fee of R140.00. Once the request is assessed, an access fee and, where applicable, a deposit may be payable before the record is provided (see paragraph 11).
  5. We will decide on the request within 30 days of receipt (this period may be extended by a further 30 days in the circumstances allowed by PAIA), and notify the requester of the decision, the fees payable and the right to lodge an application/complaint.

Grounds for refusal: access may be refused on the grounds set out in Chapter 4 of Part 3 of PAIA, including the mandatory protection of the privacy of third parties, commercial information of third parties, confidential information, and records privileged from production in legal proceedings.

Remedies: a requester (or affected third party) who is dissatisfied with a decision may apply to a court as contemplated in section 78 of PAIA, and/or lodge a complaint with the Information Regulator at PAIAComplaints@inforegulator.org.za.

The following fees are prescribed under PAIA for private bodies (as amended in 2021). The full schedule is available from the Information Regulator.
